Trump Administration Won’t Defend ACA; Says Protection for Covering Pre-Existing Conditions is Unconstitutional

On Thursday night, the Trump Administration announced that it would not defend the Affordable Care Act in court, arguing that pre-existing condition protections are unconstitutional even though the law has already been upheld by the Supreme Court.

This is false, but more importantly, it’s reckless.  More than 130 million Americans — and 5.2 million Pennsylvanians — have a pre-existing condition.  The Trump Administration is putting ALL of them at risk by refusing to defend one of the Affordable Care Act’s signature accomplishments: ending discrimination against those with pre-existing conditions.
