The U.S. Supreme Court just missed another chance to stop out-of-control gerrymandering. They sent Common Cause v. Rucho — our lawsuit to overturn outrageous partisan gerrymandering in North Carolina and end it nationwide — back to the lower court.
Our case is still alive, but the road to victory just got a bit longer. We’re still confident that our case won’t run into the same issues that stopped Gill and Benisek — the two cases the Court passed on last week. But now, we need to go back for another round of litigating to demonstrate without a doubt that our legal approach is the key to ending gerrymandering for good. We already won Common Cause v. Rucho in the lower court. Although the Supreme Court wants the trial court to take another look at this case, it will almost certainly be back in front of the Justices. We welcome the challenge, and couldn’t imagine a more winnable case — because North Carolina’s legislative map is one of the most egregiously gerrymandered in the nation.
We offered undeniable proof that North Carolina lawmakers went out of their way to disenfranchise voters — with one legislator admitting as much on video in a public hearing. Plus, our lawyers have a solid argument that any manipulation of the maps for partisan advantage is unconstitutional and needs to end.
We know what happens when we let politicians control the redistricting process. They draw “safe” districts so they don’t have to be accountable to their voters. They pack and crack communities to deny people of color fair representation. And they deny us all our constitutional right to a meaningful choice when we select our representatives.
This might be our last chance to end gerrymandering BEFORE new districts are drawn in 2021. No liberty is more fundamental than the right to freely choose our representatives through fair voting. Now, on the verge of this high-stakes Supreme Court battle, it’s on each of us to step up for what’s right.
