New PA Legislation Provides a Win for Housing Stakeholders

Senate Bill 109 (SB109) passed the House and the Senate last week. Thank you, Senate and House Republicans and Democrats, for quickly getting this legislation to the Governor’s Desk for signature. Not only was the passage of SB109 a win for bipartisanship, it’s a win for the thousands of tenants, landlords, and utility providers awaiting the federal emergency funds to pay rent and utility bills.  Many of the Housing Alliance’s recommendations are a part of the final bill.

Here’s a quick summary of SB109:

  • DHS will administer the program and not exceed 1% to administer the program
  • All of the Commonwealth’s counties are eligible to participate
    • 9.09% of the Commonwealth’s share of the federal funds can be used for associated administrative costs and housing stability services
    • Counties that participate can use up to 5% for administrative costs and 4.09% for housing stabilization services
  • Funds used for
    • Rental assistance
    • Rent
    • Rent arrears
    • Utilities and home energy costs (excluding telecommunications)
    • Utilities and home energy cost arrears (excluding telecommunications)
  • Tenants or landlords can apply with the hope that landlords will participate and apply for the assistance

This legislation has now been signed by Governor Wolf and has become PA Act 1 of 2021.
