Last week, the Bureau of Prisons (BOP) sent a 76-year-old cancer survivor and grandmother back to federal prison. Gwendolyn Levi had been on home confinement for a year under the CARES Act. She now sits in a D.C. jail.
Why was Gwen sent back to prison? Because she didn’t answer her phone while she was in a computer class. You read that right.
How did this happen? Well, in the last days of the Trump administration, the Office of Legal Counsel (OLC) dropped a memo saying people released to home confinement during the height of COVID should be sent back to prison after the pandemic. Gwen wrote to FAMM shortly after the memo came to light, saying she wanted to help. She soon became the face of the home confinement issue. Her story was so powerful and such a clear example of why the people on home confinement didn’t need to go back to prison.
Unfortunately, despite our repeated calls for action, the Biden administration has done nothing. And now some people are being sent back for minor violations — like Gwen not answering one call from her federal probation officer while she was in class.
This is an absolute disgrace. My heart aches for Gwen and her family. She and the 4,000 people on home confinement need to be assured that they can stay home.
